Welcome to Evolvia Collective ("we," "us," or "our"). These Terms and Conditions govern your access to and use of our website, as well as the purchase of our digital products, live coaching, consulting services, and career transition programs.

By purchasing or booking any product or service through Evolvia Collective, you agree to be bound by these Terms. If you are an EU resident purchasing as a consumer, statutory EU consumer laws apply to your order.

2. SCOPE OF PRODUCTS & SERVICES

Evolvia Collective offers two primary categories of offers:

1. Digital Content: Downloadable documents, electronic materials, recorded programs, and software tools.

2. Services & Live Programs: One-on-one and group live coaching, consulting, personal development programs, and live career transition sessions delivered online or in person.

3. PRICES, PROMOTIONS & PAYMENT

• Pricing & Tax: Prices are displayed inclusive of applicable Value Added Tax (VAT) for EU consumers, calculated based on the customer’s country of residence.

• Payment Terms: Payment for digital downloads and coaching packages must be made in full prior to delivery or scheduling, unless an official installment plan is explicitly agreed upon in writing.

• Promotional Discounts: Discount codes or promotional offers must be applied during checkout. They cannot be applied retroactively and hold no cash value.

4. EU RIGHT OF WITHDRAWAL & CANCELLATION POLICIES

Under EU Directive 2011/83/EU, consumers located in the European Union generally have a statutory 14-day right to withdraw from distance contracts. How this right applies depends on the type of product or service purchased:

A. For Instant Digital Content (Documents & Recorded Programs)

• When purchasing instant digital downloads, you explicitly request and consent to immediate access to the content.

• Loss of Withdrawal Right: You acknowledge that by starting the download or accessing the digital content immediately, you waive and lose your 14-day statutory right of withdrawal. All sales of non-defective digital downloads are final.

B. For Live Coaching, Consulting & Live Transition Programs

• Standard 14-Day Right: You have 14 days from the purchase date to cancel live coaching or consulting packages and receive a full refund, provided no live sessions have taken place.

• Express Request for Early Performance: If you request to schedule or attend a live session within this 14-day window, you agree that Evolvia will perform the service early.

  • If you cancel after a session has already taken place, you will receive a pro-rata refund for the remaining unused sessions, minus the fair market value of the sessions already delivered.

  • If the program or single session is fully completed within the 14-day window at your request, your right of withdrawal is fully exhausted.

5. RESCHEDULING & CANCELLATION OF SESSIONS (COACHING & CONSULTING)

• 24-Hour Rescheduling Window: Individual live coaching or consulting sessions can be rescheduled free of charge provided you notify Evolvia at least 24 hours prior to the scheduled appointment.

• Late Cancellations & No-Shows: Cancellations made with less than 24 hours' notice, or missed appointments without notice, will be charged at the full rate and deducted from your package balance.

6. NATURE OF COACHING & CLIENT RESPONSIBILITY

• Scope: Coaching and career transition programs offered by Evolvia are designed to support personal development, professional strategy, and decision-making.

• No Guarantees: Evolvia does not guarantee specific career outcomes, employment offers, income increases, or psychological outcomes. You retain sole responsibility for your personal choices, career decisions, and business implementations.

• Medical / Therapy Disclaimer: Coaching and consulting services provided by Evolvia do not constitute licensed psychotherapy, medical advice, or legal counsel.

7. INTELLECTUAL PROPERTY & USAGE RIGHTS

• All materials, documents, frameworks, methodologies, slides, and digital tools provided during coaching programs or downloaded from the website remain the exclusive intellectual property of Evolvia.

• License: Purchases grant you a personal, non-transferable, non-exclusive license to use the materials for your personal development. You may not resell, reproduce, distribute, or publicly share Evolvia’s materials without written consent.

8. APPLICABLE LAW & EU DISPUTE RESOLUTION

• Governing Law: These Terms are governed by the laws of Germany, without depriving you of mandatory consumer protections under your local law.

• Online Dispute Resolution: EU consumers may submit unresolved disputes to the European Commission’s Online Dispute Resolution (ODR) platform or local accredited consumer mediation boards.
